How To Get Canadian PR & WP With Spousal Sponsorship

Mandatory Requirements：

Sponsor Must Be:

• 18 years old or above
• Is a Canadian Permanent Resident (PR) or citizen
• Living in Canada (unless you are a citizen)
• In the past 5 years, did NOT obtain PR status via spousal sponsorship
• In the past 3 years, did NOT sponsor another person
• Is NOT on any government assistance
• Can support self and applicant financially
• Is in a genuine romantic relationship with the applicant
• NOT bankrupt
• NO criminal record

 

Genuine Relationship：

1. Married Spouse

• Mandatory: legally married in any country – but marriage certificate must be translated into English & notarized
• Preferred to have:
  • Long time together
  • Support of Family & Friends
  • Financial Interdependence (jointly own real estate & bank accounts; each other’s beneficiary on insurance; file taxes together ）
• Legal fees:
  • $5000 + HST PR application
  • $800 + HST Work Permit
• IRCC Fees：
  • $1050 PR application
  • $255 Work Permit

 

2. Common-Law Partners

• Mandatory: living together for at least 1 year（can be in any country）； proof include：
  • Lease agreement or real estate ownership – sponsor & applicant’s name both on it
  • Both parties’ driver’s license show the same address
  • Both parties’ driver’s utilities bill show the same address
• Preferred to have:
  • Long time together
  • Support of Family & Friends
  • Financial Interdependence（Jointly own real estate & bank accounts；each other’s beneficiary on insurance; file taxes together ）

  • $5000 + HST PR application
  • $800 + HST Work Permit

3. Conjugal Relationship

• Mandatory：at least 1 year of intimate relationship（can be in any country）- but could not live together due to factors beyond their control； Proof include：
  • Love letters
  • Regular communications
• Preferred to have:

Financial Ability

• No mandatory requirements, UNLESS principal applicant have grandchild(ren) who requires their support
• Must convince IRCC agent that sponsor can support self and applicant with no need for government aid

 

 

Processing Time:

Varity Law Prep. Time – 2 weeks to 1 month after we are hired (depends on how co-operative the applicant is)

IRCC processing time:

• 3 months for work permit
• 6 months – 1 year for PR application
